/><br />回到该部落客,作者也提到股东大会:<br /><br /><span> “因工作需要,我常出席很多上市公司的股东大会,会后通</span><wbr><span class="word_break"></span><span>常有茶点或午餐招待,而我总是看到争夺食物的场面总是不</span><wbr><span class="word_break"></span>停的上演。<br /><br /><span> 更 甚的是很多华裔还带了plastic盒和纸袋来打包,我</span><wbr><span class="word_break"></span><span>就曾亲眼目睹一个AUNTIE,在股东大会 后把coffee & tea station的那些糖包全部扫进她的包包里,连炼乳也</span><wbr><span class="word_break"></span><span>不放过!!倒进她带来的小瓶子!!这还没有完结,当时我</span><wbr><span class="word_break"></span><span>站在她的旁边,看得目瞪口呆,她还好意思对 我说:啊,这个酒店的碟子很美(也就是那种白色的普通瓷</span><wbr><span 近出席一个官联公司的股东大会也是如此,从汹涌的人潮估</span><wbr><span class="word_break"></span><span>计,签到的股东有3千多人,但是过后当会议正式开始的时</span><wbr><span class="word_break"></span><span>候,在会议大堂里的人数却不到200人!! 那些人去了那里?那是因为这家官联公司,在会议开始前就</span><wbr><span class="word_break"></span><span>送了礼物(电器一份),它没有准备午餐,但却送了KFC</span><wbr><span class="word_break"></span><span>的免费餐券;换句话说,就算这些贪小便宜的 股东待到会议结束(接近2个小时),也不会再有额外的好</span><wbr><span class="word_break"></span><span>康,那么,还留下来干什么?以为他们真的是sincer</span><wbr><span class="word_break"></span><span>e investors吗?股票交易所、证券委员会和小股东</span><wbr><span class="word_break"></span><span>监督机构不断的进行投资者教育,培养出来的却是这些只为</span><wbr><span class="word_break"></span><span>来拿免费礼物吃大餐的股东,真正准备就绪向 各上市公司发出问题的股东只属少数人。有这么多贪小便宜</span><wbr><span class="word_break"></span><span>的股东,难怪我们的上市公司当中,有很多的企业监管出问</span><wbr><span class="word_break"></span>题,弊病百出。”<br /><br /><span> 相比下,大学也是同样的情景。我们有没有想过所缴交的学</span><wbr><span class="word_break"></span><span>费到底用在什么地方?校方的财政是否透明,整个大学内地</span><wbr><span class="word_break"></span><span>招标过程如何(包括食堂、清洁工作、工程、巴士服务、复</span><wbr><span class="word_break"></span><span>印设备、电脑等)。我始终坚信,制度和政策改革才是最佳</span><wbr><span class="word_break"></span><span>方案。大家试想想,若是学生力量强大,食堂负责人看给我</span><wbr><span class="word_break"></span><span>们吃难吃又贵的食物吗?、巴士公司敢不准时吗?关键就在</span><wbr><span class="word_break"></span><span>招标的决策权!学生必须要有力量,监督他们!也就因为如</span><wbr><span class="word_break"></span><span>此会影响到某些利益集团的好处,所以他们要分裂学生,扶</span><wbr><span class="word_break"></span><span>植一群学生当爪牙!这和当年英国殖民地政府扶植一群本土</span><wbr><span class="word_break"></span><span>利益集团、日本侵略者在南京扶植汪精卫汉奸伪政权及今天</span><wbr><span class="word_break"></span><span>的美国在伊拉克为了油田而扶植亲美势力是同工异曲的!还</span><wbr><span class="word_break"></span>记得我新生的时候,法律系教授Azmi Sharom 就在主讲校园选举醒觉讲座会时曾经问过大家一句话: ARE YOU SO CHEAP?<br /><br /><span> 的确,我们亲学生阵线的处境是“条条绳子,处处陷阱,危</span><wbr><span class="word_break"></span><span>机四伏,防不胜防,欲不触雷,殆无可能”,但,我们坚信</span><wbr><span class="word_break"></span><span>,虽屈于今日,必申于将来。面对在多点苦难,也有处之泰</span><wbr><span class="word_break"></span><span>然,沉着应对。横挥铁腕批龙甲,怒奋空拳搏虎头;这是我</span><wbr><span class="word_break"></span>们的选择,历史必会给我们一个交代。<br Politics and spirituality!?! Duh? Hello. If you like freedom, democracy, have any sense of justice and fairness, and wish your children to have adequate food, shelter, energy, and medical care. Then being engaged with functional political-economic systems in that sense is excellent as one is either participating in oppression or tyranny on one hand, or on the other hand participating in alleviating injustice, oppression, and exploitation of self and others. If a person does not care about these issues, or would rather believe that autocratic forces, God, or trusted authorities will be taking care of these matters for one, then keep dreaming, wishing, and hoping. Good luck!<br /><br />Politics, like it or not, pervades modern life. It is observed in the funding for war and the lack of funding for peace. In the amount of money allocated toward gulags and prisons, or on the other hand toward educational and economic opportunities for all. It can increase environmental toxins and disease, or it can limit and decrease such. It can ensure the free dissemination of information and data, or it can restrict it. It can foster policies of scarcity and competition, or on the other hand policies of abundance and cooperation.<br /><br />Thus political-economic systems can be an amazing force for freedom, justice, peace, abundance, and creative fulfillment when not manipulated selfishly by greedy, selfish, and oppressive dark forces. Politics impacts people and other living beings in many ways. It can come down to the bombs falling over head and killing you or your loved ones (if you live in a war zone or soon to be one). Politics governs the quality of our air, water, food, energy, and healthcare. For human beings and their families (all of us0 its policies determine if you can use a quality library, find employment after fifty, be exposed to toxic pollutants and risk environmental disease, be sent off to fight in foreign invasions or not, be robbed by the government or be robbed by desperate "others", be jailed, tortured, beaten, or punished for your beliefs or dissent, etc.<br /><br />Political policies have permeated all walks of daily life, unless one can find a perfectly isolated wilderness left alone in its pristine unexploited beauty or else attempt to view the heavens with telescopes and satellites all day long in ivory towers. It's not only difficult, but really impossible, to escape or deny, while money no longer promises to immunize one from this "reality". One may invest in expensive security guards, security systems, satellites, mercenaries, threats of torture and incarceration, escaping via spaceships, or attempt to buy tickets to heaven, but such ways of thinking only isolates one more, placing one in a very narrow self made prison of fear.<br /><br />In short, many greedy self interest groups having their own agenda attempt to exploit people and resources, educational and health care institutions, regulatory institutions, government agencies, politicians, commerce, the environment, the financial institutions, and the economy incessantly for their narrow-minded agendas. Such political influences have to be recognized in order to rectify it. Ignoring it simply allows one to become unknowingly victimized and manipulated by it unconsciously harboring a delusion that one is somehow franchised as long as one goes along with the rules. That's an attitude held over from serfdom (read slavery). Worse it's an illusion. When serfs/slaves become worthless to the lords of greed, they are disposed of in an efficient manner. All human beings are subject to old age, sickness, and death and hence to the exploiter mentality, they have become useless.<br /><br />In fact the manipulators and rulers would prefer that one did not participate in the political process (democracy), and hence the dark side of "politics" is thus promoted, discouraging people from becoming actively engaged for claiming responsibility for their future and future generations, righting injustice, creating a sustainable life supporting environment, and helping others to awaken to their innate creative fulfillment. In this latter sense political activity can be the road to social happiness and justice, abundance, sustainability, freedom, and spiritual fulfillment. For awakened , informed, and human beings who still have a living sense of justice (honoring the lifeforce within and without), political activity can be very empowering when regarded in this light. It can be the means to assure the happiness of our future great great grandchildren should we dare to broaden the scope of our vision and activities accordingly.<br /><br />Authentic or real politics is essential to a democracy and a happy people. That does not mean power politics for power's sake like most of today's expedient (read deceptive and corrupt) politics has become today. Rather by real and authentic politics, it is meant a system where people have a say in governing themselves and changing their own future and destiny in the direction that is best for them and their children according to their own values, rather than to be governed by would be slave owners.<br /><br />That sounds simple enough doesn't it, but I think that most Americans don't know the value of freedom (democracy) because they don't want to be bothered being informed. Democracy can't work without people being informed, of course. The same about the economy. It ain't complex either. Just because the "experts" say it is complicated and complex, it doesn't make it so. Real economic systems based on life affirming values are simply methods to efficiently expedite, distribute, and access water, food, energy, transportation, and medical care amongst a group of people. When that is accomplished expediently, then any time and resources left over is used for recreation, free time, creativity, and individual pursuits. If "free time" is becoming less available or vital resources/services dwindling, then that is a clear indicator that the economic system is not working and requires adjustment. In the end an authentic political-economic system is compassionate; i.e., it serves the needs of the people and future generations. That way we look forward to the morrow, free from worry, stress, or apprehension.<br /><br />This kind of politics is reflected in wisdom, light, love, vision, abundance, justice, and ahimsa which is natural to an awakened heart. For those mired in darkness, fear, greed, selfishness, scarcity, and competition, they can not recognize it as such, rather they will project their own selfish motives upon "others" because that is what composes their own mindset or "world view" -- that. which is within their own minds and conveniently placate their egoic self deceit by imagining and imputing that love, compassion, justice, and altruism is its opposite; i.e., a disguise for jealousy and greed.<br /><br />This article was originally written as an introduction to Rainbowbody's Healthy and Green Politics page, but it grew naturally as a seed into a flower of its own, and hence has been continued here. Here we will show that there is a direct interactive correspondence between man's institutionalized apparatus which externalizes and propagates ignorance and suffering through events, and the pre-existing institutionalization of ignorance and suffering that resides in the human psyche. We will show that there exists a direct correspondence between human behavior, activities, and hence the institutions that man creates as being direct results of human consciousness (a prior mindset) which is either lacking consciousness or is on the other hand informed and wise.<br /><br />Consciousness or its lack shape and/or permit either abuse, exploitation, oppression, injury, and continued suffering to occur on one hand if it is unhealthy, sociopathic, pathological, dysfunctional, and perverted/corrupted; or on the other hand, consciousness can support healing, liberation, creativity, integrity, abundance, cooperation, peace, and happiness if it is healthy, functional, biosocial, based in the values inherent in the community of life, integrated, and wholistic; i.e., sane. The former relationship is what the psychiatrist, Erich Fromm, termed necrophilia (the love of death and destruction), while it is opposed by biophilia -- the love of life. Hence the social and political problems facing the human being are iatrogenic (self caused). The causal factors at their root are essentially psychological or spiritual, hence it is worthwhile to look into the reasons why this spiritual flowering and unfoldment has become stifled and repressed and in doing so we will uncover and identify institutions which serve to repress and inhibit critical, creative, and free thought.<br /><br />For many humans who are partially awake these connections are obvious; i.e., that consciousness (and/or its lack) shapes man's behavior, institutions, and politics on one hand; while also that man's environment, culture, institutions, society, and experiences shape his/her consciousness as a simultaneously occurring or symbiotic two way street. Both are true, but neither is true exclusively.<br /><br />For too many years this obvious connection between consciousness and behavior, between psychology and politics, between spirituality and political-economic systems, between psychology and socioeconomic, agricultural, ecological, and medical systems, etc., has been widely ignored and even purposively obfuscated by forces allied with ignorance and darkness -- with selfishness and greed. Such connections between sky and earth, spirit and nature, psyche and soma, consciousness and beingness have rarely been integrated (except in indigenous societies) of whom have been under attack especially in the West for 2000 years. Thus a widespread but artificially created pre-existing problem has been that consciousness expansion, spirituality, and the so called human potential movement has heretofore been poorly linked to social and political activities. Such a separation on a daily basis has artificially reinforced a needless spiritual rift (dematerialization) between so called earth/body positive"spirituality" and social activism whose schism unfortunately and dysfunctionally continues to erode human progress and happiness while creating needless suffering. The task is obvious. An authentic living spirituality must be embodied and allowed to manifest in daily life. Such must be part of a sane and healthy way of integrity which honors life and creativity which we will discuss in more detail later on.<br /><br />This connection between consciousness and politics -- or rather between political action inside an overall spiritual context which honors our connection and co-creative interdependence with life support systems (Systems that support life) by honoring the greater community which upholds it and from which it has sprung, requires acknowledgement at a fundamental level of "self" as a part of (not apart from) the evolutionary power of creation. The connections between our persona and our environment should be obvious to anyone who has learned critical and creative thinking; but modern day urban institutionalized propaganda and rigid institutionalized ideology will refuse to link the two. Rather such self serving institutions serves to obviate them in an attempt to fragment human beings from the source of their innate power and goodness.<br /><br />The "Good" News is that this acknowledgement of this symbiotic relationship between consciousness and beingness (our actual experience) empowers us while allowing and enabling sentient beings who have been awakened to change the future positively through skillful loving wise action. The bad news is that there exists self interested institutionalized forces afoot on the planet with greedy agendas and well funded strategies, who do not wish humans to wake up and bridge this gap, because such is judged as a threat to their perceived "advantage" (their perverse identification with the status quo in terms of their comparative advantage, security, greed, self image and thus is associated with mental fear, pain, and feeling of lack of self worth). Those who are awake and in the light and who are propagating wisdom and compassion are still in a minority. Similarly those who are consciously promoting ignorance, destruction, darkness, greed, control, and egoic power over others selfishly are also in the minority. The majority are sleepy people who see only a faint shadow or hollow phantom of what they are missing/craving or fearing, thus they become easy victims, slaves, and purveyors of a neurotic consumer oriented society and political machine which pursues ersatz consumables and vague symbolic representation as substitute compensation for the basic displacement/rend from being a vital conscious participant of the dynamic evolutionary and creative force. In that way willing consumers become accomplices in perpetuating their own state of need and anguish, which can not fulfil (except in over indulgent orgies of excess (such as over eating, drug abuse, alcohol addiction, other avenues of insatiable greed, until they become sick, recognize their folly, and desire to wake up and become free. Currently this neurotic consumer driven malaise (driven by insatiable greed) is a major factor in ruining the ecosystems of the planet.<br /><br />With this compensatory neurotic apparatus reinforced, when one has become so invested and convinced, it then becomes more difficult for the average consumer to let go of their ersatz compensatory opiate/pabulum and addictions. However "kicking that habit" (renunciation of neurotic compensatory consumerism) is a powerful first step which supports further realization of their innate dormant higher potential -- the aforementioned healthy wholistic natural state of vital integrity which was lost sight of before the psychological conditioning, negative programming, perversion and corruption of one's psyche/consciousness became dominant. Worse people so addicted and dependent upon such false identifications will cling to and defend it; i.e., their egoic self image (pride) which is rooted in separation and isolation, will feel threatened by paradigms which expose or reveal its contradiction. That is because this false identification has succeeded in becoming familiar known territory and predictable, thus one chronically mistakes safety and well being with predictability. Thus they will tend to resist their own liberation from their own self imposed bondage to addiction because of a fear of unpredictability or change. Change will appear threatening instead of liberating.<br /><br />Even worse they will tend to hide and deny their consumer addictions through defending and glorifying it in a self defensive/aggressive pride especially through psychopathological methods of demonizing their perceived detractors which is really the externalization of their own inner conflict and demons. These are psychological resistances and armoring of the ego which manifest when people who identify with their beliefs about themselves and "the world", but who have not yet looked at the mechanism on how those beliefs have become assumed. They have not learned how to question those assumptions and trust their own innate critical thought processes. Indeed even questioning their beliefs appears to such as a personal threat rather than as an opportunity to self liberate and expand. One way that human beings change is by suffering; i.e., when there is nothing more to lose, then they will more easily rebel. However such solutions based on scarcity and desire, wind up in the long run repeating the scenario of scarcity until this great lesson is learned; i.e., that we are all one big family -- that the quality, richness, and depth of life is not found in the individual's accumulation of more things and their protection/maintenance. The more things humans need and own are signs of discontent and spiritual displacement. They are signs of how much they crave, need, and are unhappy.<br /><br />Thus the remedial mechanism for the political milieu will be shown to be a spiritual/psychological mechanism of waking up, of regaining our inherent integrity, wholeness, spiritual health, sense of justice, sensitivity to the life force, and increased consciousness which was perverted/co-opted through negative programming. This will be shown as being the same process as throwing off the impure thoughts, false beliefs, propaganda, and illusions of fragment identifications as a clearing of the contraction of the heart, because as the sky clears the clouds go away -- the sun shines through without complicated contrivation and fabricated rationalization.<br /><br />People who honor love, do not kill, hate, rob, exploit, harm or oppress others. Peaceful minds, honor peace -- they make peace. Inner peace comes from a deep realization of who we truly are -- where the inner demons of the corruptive HeartMind have become conquered. Inner peace is a result of realizing who we are in completion -- as eternal unrequited love. Here there is no room for hatred or fear, only love, joy, fulfillment, compassion, comfort, and light. People who know fulfillment and joy are neither insatiable nor insecure. Successful people no longer incessantly strive, but rather they engender peace and fullness. Loving people make love, rather than hate, murder, or war. One who has found love, values and honors love, peace, and abundance attempts to enhance it. Such a person is motivated by such stirrings deeply from their core. As such peace is not passivity, but active -- it is the activity of love. Such people would not honor systems that create scarcity, competition, stealing from others, comparative advantage, war, or strife. Similarly, people whose HeartMind have become clarified and open love and honor freedom and do not enslave, oppress, nor support totalitarian police states. Rather they become engaged in wise activities which liberate, remove suffering, heal, and celebrate a life wedded in Great Spirit -- their actions acknowledge and honor the sacred in All Our Relations.<br /><br />In identifying the causes of oppression and suffering we thus have to avoid obsessing "about" the negative (hate, greed, fear, and selfishness) of our fellow humanss especially so when we live in a materialistic, competitive, militaristic, capitalist, gulag society. This is not to say that one should turn away and ignore the oppression, exploitation, and lies while leaving them unacknowledged. However it will do no effective spiritual good to simply condemn it in outrage; or on the other hand glorify the perfection of love as a spiritual process on the other hand. The t the authentic challenge is in bringing the love, light, truth, happiness, kindness, justice, and joy through where it is absent -- grounding and manifesting spirit in everyday life -- embodying love and spirit in integrity here upon the earth as in "thy kingdom come -- thy will be done, here on earth as in heaven". This is the spiritual work of cleansing the HeartMind detailed elsewhere on Rainbowbody.net; however here we address the activities of the Heart versus activities of men whose hearts are occluded. Framed in this way, it is not a condemnation of others but an inquiry how humans have arrived at precipices of strife and dysfunction, and as such teaches the lesson of history, how we can learn not to repeat such errors of learning the hard way -- through more pain and suffering -- until wisdom dawns!<br /><br />Processes based on love, compassion, ahimsa, justice, and peace do not encourage nor reward suffering, comparative advantage, greed, jealousy, adversity, hatred, fear, competition, strife, and more confusion. It doesn't take a genius to figure this out, but it does require a healthy mind and a good heart. It requires some degree of sensitivity, awareness, and sanity as well. It is taken as a given (a priori) that people collectively moved by transpersonal universal love are capable of moving mountains -- that when we act motivated by the universal non-dual Source (Great Integrity) acting in alignment and harmony with the natural joy of spirit, healing, abundance, wealth, peace, then true happiness manifests. This basic assumption of a natural altruistic ambition forms a most powerful momentum of its own. It opposes the perverse idea that man must be motivated by the whip, by scarcity, conflict, competition, fear, intimidation, greed, threat, or negative ambition.<br /><br />Hence we return to the first paragraph:<br /><br /> "Through Universal Altruism we develop a feeling of true responsibility toward others; the wish to help all actively over come our problems".The Dalai Lama of Tibet<br /><br />We have said that freedom has a price. In a democracy it is called, responsibility. Freedom does not mean to give up that responsibility to crooks or tyrants. That responsibility is not discharged by simply voting (giving consent). First a true democrat (one who values democracy) has to value freedom which requires becoming informed and free of the propaganda. That requires a critical and creative thought process -- a mindset that values truth over lies as well as free access to information. So the responsibility is to be informed while at the same time throwing off the propaganda of belief systems which desire to manipulate your mind (and hence manipulate you as their servants/slaves). Then one can act responsibly and effectively in helping self and others. That can move us into a happier, more just, and spiritual situation.<br /><br />To sum up so far, mankind's long history of war, murder, plunder, exploitation, violence, rapaciousness, and suffering thus is not a natural phenomena (although normal) at all, but rather is a perversion and corruption, a fragmentation, a falling away from innate integration, from All Our Relations. It is fundamentally unnatural and anti-nature. It is egoic, arrogant, and based on the delusion that human can be separate and independent from nature and primordial wisdom -- from the Big Family. As such it is merely a symptom of man acting out from his spiritual malaise -- his alienated or out of attunement/alignment with the wholeness of creation/creator. Simply put all abuses, injury, oppression, and suffering that man brings upon himself is due to a basic spiritual pollution and spiritual self alienation -- a primal rift or separation -- the false identification of the self limitation imposed by the small self (ego) who arrogantly imagines himself to be independent-- a lack of "Self" understanding which has become institutionalized, an institutionalized and programmed barrier, obstruction, or impurity which has stained and occluded his HeartMind.<br /><br />Here again we can divide/reduce this situation into two directions -- the direction toward Self Integrity -- the Great Binding (mahavratam) of yoga or All Our Relations-- which we will call the altruistic motive power -the pure ambition of a peace warrior, Bodhisattvas, or Christos) -- of non-dual transpersonal Love -- the power of the Great binding and Final Great Gathering. On the other hand, the aversion to this integration is a fragmentation and corruption by definition called the way of dissolution, spiritual self alienation, and false identification with a separate self or ego. This latter addiction or rather enslavement of is the neurotic or compensatory desire (motif) which contains hatred, fear, compensatory cravings and all the other secondary resultant spin offs such as greed, jealousy, competitiveness, malevolence -- all the manifold vagaries of humanity's many afflictions and oppressions. It is in the latter that the Heart has become chronically contracted and where one has lapsed into chronic forgetfulness -- "dis-memberance" -- fragmentation, alienation, corruption, and perversion. It is there in this stage where mankind has formed its pact with "sin" and corruption, where he harbors his own demons which haunt him, and which is calling for a cleansing -- where the Heart is deeply calling out to him to open up.<br /><br />Simply put the expression of eternal Love and Joy -- of All Our Relations -- opposes exploitation, abuse, harm, oppression, exploitation, suffering, and killing of others -- thus it supports freedom, well being, and peace. Further it supports abundance, life, and healing. Pure air, pure water, low crime, non-toxic environment, low crime rates, less needs for armaments, less prisons, more attention to an empowering educational system, healthy agricultural policies, cleaner air and water, non-oppressive governments, more abundance, etc. All these effects and manifestations follow naturally from a common health motif and cause. These are natural consequences of Love and happiness. They appear to be "wise" or at least sane.<br /><br /> <br />The Dysfunctional/Disempowering Mechanism of Externalization, Authoritarian/Totalitarian States, Demagoguery, and the Politics of Blame is the Result of Abandoning Self Responsibility: Freedom can only occur when we are willing and able to take "self" responsibility.<br /><br />On the other hand, when confusion, selfishness, hate, fear, jealousy, and greed dominate people's hearts -- when the Heart has become contracted, contaminated, or oppressed -- then we see the manifestations of dissatisfaction, greed, selfishness, competition, strife, hatred, envy, fear, jealousy, in over consumption, rape, war, crime, murder, theft, deception, prejudice, bigotry, abuse, waste, pollution, slavery, suffering, and the like. In this occluded, confused, and sleepy state, hate and fear -- or rather paranoia, insecurity, and greed rules and thus one's activities, behavior and politics becomes correspondingly occluded, dark, perverse, corrupt -- what is commonly called evil. Extrapolating this illusion further then, externalized "enemies" are created as if some one else or some external group was perpetuating this evil upon us and thus a scapegoat, an objectified enemy, evil, or object of hatred and blame external to "self" is manufactured. This simpleminded approach is attractive to those seeking quick and simple answers and find it difficult to think because they have been given no tools to investigate their inner demons or conflicts -- because they have been separated from their inner spiritual authenticity and authority -- from living spirit. Thus an externalized/objectified enemy serves the neurotic purpose of directing their fear and confusion into hatred and pride, because they are at once absolved from any responsibility and at the same time their frustration, grief, and anger are sublimated (discharged and relieved albeit temporarily) toward an external object. Thus in psychic terms a temporary catharsis is created and the neuroses, guilt, pain, trauma, fear, and self hatred appears temporarily relieved by objectifying a surrogate enemy or demon.<br /><br />This neurotic mechanism is more easily manipulated en mass through group illusions (creating consensus support for the illusion) as in an objectified enemy external to the group, ethnic identity, religious identity, state, or national identity, as in war. This serves the same temporary release/discharge of anxiety (fear, hate, guilt) for the neurotic again relieving self responsibility, self hatred, guilt, anger, and grief. If the enemy is associated with "evil", then the enemy of evil becomes absolved as "good". Although simpleminded this childish transference has occurred for thousands of years where demagogues have manipulated people's fears, prejudices, confusion, anger, and guilt, even to the point cooperation with their own oppression and genocide. Here a figure of authority becomes the mediator (be it king, father, fuehrer, president, priest, or pundit). This same neurotic mechanism can be invoked pointing the finger toward an internal "security" threat by a demagogue creating a totalitarian police state where no one is trusted, no individual freedoms are allowed, where critical thought and creative thought are seen as threats, where the threat of "an externalized, ubiquitous, insidious, and omni-present enemy" is amplified -- where people cower in fear and terror (and not coincidentally where fear and terror are self perpetuating). Although authoritarianism will inflate and attempt to propagate and hide behind the appearance of virtue, there can be no mistaking totalitarianism no matter how cute the mask as anything other than institutionalized slavery -- it thrives on fear, paranoia, neuroses, hatred, prejudice, suffering, and ignorance.<br /><br />Here we will link together the fact that world peace and true security comes from peaceful and psychologic/spiritually secure people, rather than from insecure people; i.e., a domestic or international "security" problem is the result of psychological/spiritual insecurity; i.e., insecure people. To root out this "security" problem must include why and how people feel insecure in the first place; i.e., what are the cause and effect factors involved. Only then can the insecurity be successfully approached and remediated. Those who advocate war are themselves at war inside of themselves. Those who see the demons everywhere are obsessed/possessed with inner demons -- which we need to exorcise. They live in a shadow world which begs for illumination and it is up to us (even though we may feel oppressed by "them" to rise above our own grief and suffering to increasingly learn how to share the light. Only together will WE walk into the Heart of Hearts -- no other.<br /><br />Here we will see that greed, jealousy, pride, hatred, and fear all come from a spiritual lack and more basic insecurity stemming from a spiritual estrangement from "Self" -- a primary sickness -- a separation from "All Our Relations". As a matter of fact all human made problems emanating from our any of our activities or institutions of so called education (which turns our children into parrots), a profit motivated disease care system (where disease pays), environmental protection (where pollution and poisons are justified), agriculture (where scarcity, starvation, and poisoning the soil, water, air, animals and people are promoted ), energy policies (where global warming, acid rain, ozone holes, and ecological destruction are promoted), and where war, crime, homelessness, disparity, inequality, scarcity, and genocide are daily promoted -- all of such are unhealthy and reflect unhealthy souls -- are a reflection of a pre-existing inner predilection and dynamic; i.e., they are all part of mankind's spiritual malaise/trauma -- the split from Self in All Our Relations. The institutionalization of this trauma has for too long governed the price of bread, the quality of our air and water, war or peace, feast or famine -- this type of government policy of course is dysfunctional and unhealthy -- it lacks joy and heart. Instead of celebrating life, it demeans it and as such it creates more self hatred and alienation. It is not due to poor leadership, but rather the willingness of the people to be misled -- to not to think for themselves and thus to not take responsibility. Vampires and parasites do not thrive unless there is carrion for them to feed upon.<br /><br />We will show that every aspect of mankind's sociopolitical structures are a direct result of his alignment with Source -- his embodiment of love and happiness on one hand, or on the other to the lack thereto. Either man integrates his Creative Loving potential into daily life -- in harmony with Creation or he will suffer accordingly. Here we will show thus that not only irrelevant sociopolitical structures and modalities (both domestic and foreign) are affected, but rather our daily life in terms of the air we breathe, the cost of our food, how much we work; i.e., in terms of basic agricultural policies, health care policies, education policies, environmental policies, and the like all are concomitant as a cultural reflection of man's persona -- his identification and alignment with Source (creator) and Substance (Creation) or else his separation or corruption from it -- its absence. It is in this sacred field which living spirit plays the dominant role in our daily institutions which today is severely lacking because it governs our daily quality of life. This situation requires mankind's attention acknowledgement, consciousness, and embrace. As such it is a inner spiritual process first because before man can see the love and manifest it, he first has to experience it. Merely reading about it will not suffice.<br /><br />In this light then any economic system can be evaluated in the light of this field -- of how well it brings forth abundance, love, peace, well being, health, self empowerment of its citizens, freedom, and happiness. Thus healthy food, health care, agricultural policies, work safety, environmental health, eco-systems, education, social security are all very much inter-related. It does not take much thought to link the facts that clean air, clean water, and clean food are necessary and vital to any economy that those who would justify poisoned air, toxic water, and cancerous food products are themselves toxic, poisonous, corrupt and polluted -- their minds and bodies have become corrupted; just as much those who religiously advocate competition, strife, scarcity, wars, prisons, exploitation of natural resources and people as "necessary" motivation. Indeed it does not require much thought at all to see that removing violence and harm to all beings as a motif and ambition will effect a higher quality of life, less waste, and more pro-active policies all bringing more abundance. The reason that such a motif has not been adopted is not so much that the greedy and powerful status quo parasitical vampires wish to keep their advantage in terms of increased status, wealth, and power (simply read fear, insecurity, attachment, and greed) and will stop at no deceit or abuse to keep such, but rather it is because that not enough loving and wise people have awoke -- have refused to become the symbionts for their own oppression.<br /><br />Thus it should be clear that the way of the open and clear heart playing in the sacred field of love, well being, joy, and fulfillment differs greatly from that of the constricted heart anguishing in the bitter depths of desire, greed, paranoia, fear, disparity, greed, and competition. We will see how the former healthy spiritual perspective clashes with the latter and show their differing veins which run through the rungs of history in a psycho-history, spiritual history, or new 一切都要這樣絕對呢?你自己對摯愛的人都有時會發個脾氣,為什麼有時就因為別人發個小脾氣就認為他十惡不赦,他不愛你了呢?多年來我完全不敢寫任何時事的 感受,因為很容易就被歸類,所以選擇自我評量,自己依著良心盡可能做好自己,只是看著這樣可愛的人民,卻在自己的家裡內鬥,真的是很難過、傷心。其實大部分生活在這片土地上的人都是愛這裡的,我們不該去質疑自己的兄弟姐妹...是否愛我們的家。當然我們會批判它,因為我們希望家裡可以更好,但請一直惦記著:這一切都是因為『愛』,我們可以對政策作批判,但對人請更寬容些。 /><br />梦里:有一天我忽然被传召去法庭,法官问我说-“你三年前犯法,告诉我为什么你不应该人头落地”。我不懂什么事,啊一声。法官马上说:说不出,你有罪,马上去排队斩头“。<br /><br />接着我看见一名法律系的高才生,问他怎么会这样?这完全不符合宪法、不符合行政法、不符合刑事法典。。。。但那条水居然说:"这完全依照法律程序,没有问题”。天啊,怎么他这么没有良心。这时我联想到几年前有位曾经替杀人凶手辩护的律师说:帮坏人时,不要看事件,不要看什么事,只看法律程序-抓程序漏洞,明显杀人都会无罪释放”。这时我才明白,什么公正啊,法律是正义的,都是在骗人-都是暴政的工具,及依据为虎作帐,贩卖良心的法律专才的生才工具。。。。。虚伪<br /><br />过后我只好要求,给我打个电话。法官这时笑着说:我国是个尊重人权的国家,死囚可以打电话回家交代身后事“。。。。真是够虚伪。这时我连忙打电话给女朋友,叫她忘记我,不要伤心,找别人吧”。过后再打电话各家人,惨,妹妹不接我的电话,在联络弟弟,也不接。法庭这时还说,法庭是庄严的,要有文化,文明人是不会再法庭讲电话的,结果我就在守卫监督下在外面打电话。<br /><br />周围守卫没有几人,被斩头的人很多;每个都乖乖排队被杀,没有手铐,没有大批守卫-被杀的人至少多过守卫的十倍。但他们就好像被奴化了,完全不会反抗。这时我看见一名记者在哭,她没有相机,手里的笔记也是空的。。。。原来,这个国家,报纸只能报导官方消息,记者可以来法庭/邢场-是为了表现政府很民主,很尊重媒体。。。。。。。操<br /><br />天啊,这时什么混蛋世界。。。。。。<br /><br />一、前言<br /><br /> 今年是中国立宪百年,《世界人权宣言》公布60周年,"民主墙"诞生30周年,中国政府签署《公民权利和政治权利国际公约》10周年。在经历了长期的人权灾难和艰难曲折的抗争历程之后,觉醒的中国公民日渐清楚地认识到,自由、平等、人权是人类共同的普世价值;民主、共和、宪政是现代政治的基本制度架构。抽离了这些普世价值和基本政制架构的"现代化",是剥夺人的权利、腐蚀人性、摧毁人的尊严的灾难过程。21世纪的中国将走向何方,是继续这种威权统治下的"<br />现代化",还是认同普世价值、融入主流文明、建立民主政体?这是一个不容回避的抉择。<br /><br />19世纪中期的历史巨变,暴露了中国传统专制制度的腐朽,揭开了中华大地上"数千年未有之大变局"的序幕。洋务运动追求器物层面的进良,甲午战败再次暴露了体制的过时;戊戌变法触及到制度层面的革新,终因顽固派的残酷镇压而归于失败;辛亥革命在表面上埋葬了延续2000多年的皇权制度,建立了亚洲第一个共和国。囿于当时内忧外患的特定历史条件,共和政体只是昙花一现,专制主义旋即卷土重来。器物模仿和制度更新的失败,推动国人深入到对文化病根的反思,遂有以"科学与民主"为旗帜的"五四"新文化运动,因内战频仍和外敌入侵,中国政治民主化历程被迫中断。抗日战争胜利后的中国再次开启了宪政历程,然而国共内战的结果使中国陷入了现代极权主义的深渊。1949年建立的"新中国",名义上是"人民共和国",实质上是"党天下"。执政党垄断了所有政治、经济和社会资源,制造了反右、大跃进、文革、六四、打压民间宗教活动与维权运动等一系列人权灾难,致使数千万人失去生命,国民和国家都付出了极为惨重的代价。<br /><br />二十世纪后期的"改革开放",使中国摆脱了毛泽东时代的普遍贫困和绝对极权,民间财富和民众生活水平有了大幅度提高,个人的经济自由和社会权利得到部分恢复,公民社会开始生长,民间对人权和政治自由的呼声日益高涨。执政者也在进行走向市场化和私有化的经济改革的同时,开始了从拒绝人权到逐渐承认人权的转变。中国政府于1997年、1998年分别签署了两个重要的国际人权公约,全国人大于2004年通过修宪把"尊重和保障人权"写进宪法,今年又承诺制订和推行《国家人权行动计划》。但是,这些政治进步迄今为止大多停留在纸面上;有法律而无法治,有宪法而无宪政,仍然是有目共睹的政治现实。执政集团继续坚持维系威权统治,排拒政治变革,由此导致官场腐败,法治难立,人权不彰,道德沦丧,社会两极分化,经济畸形发展,自然环境和人文环境遭到双重破坏,公民的自由、财产和追求幸福的权利得不到制度化的保障,各种社会矛盾不断积累,不满情绪持续高涨,特别是官民对立激化和群体事件激增,正在显示着灾难性的失控趋势,现行体制的落伍已经到了非改不可的地步。<br />二、我们的基本理念<br /><br /> 当此决定中国未来命运的历史关头,有必要反思百年来的现代化历程,重申如下基本理念:<br /><br /> * 自由:自由是普世价值的核心之所在。言论、出版、信仰、集会、结社、迁徙、罢工和游行示威等权利都是自由的具体体现。自由不昌,则无现代文明可言。<br /> * 人权:人权不是国家的赐予,而是每个人与生俱来就享有的权利。保障人权,既是政府的首要目标和公共权力合法性的基础,也是"以人为本"的内在要求。中国的历次政治灾难都与执政当局对人权的无视密切相关。人是国家的主体,国家服务于人民,政府为人民而存在。<br /> * 平等:每一个个体的人,不论社会地位、职业、性别、经济状况、种族、肤色、宗教或政治信仰,其人格、尊严、自由都是平等的。必须落实法律面前人人平等的原则,落实公民的社会、经济、文化、政治权利平等的原则。<br /> * 共和:共和就是"大家共治,和平共生",就是分权制衡与利益平衡,就是多种利益成分、不同社会集团、多元文化与信仰追求的群体,在平等参与、公平竞争、共同议政的基础上,以和平的方式处理公共事务。<br /> * 民主:最基本的涵义是主权在民和民选政府。<br /> 民主具有如下基本特点:<br /> (1)政权的合法性来自人民,政治权力来源于人民;<br /> (2)政治统治经过人民选择,<br /> (3)公民享有真正的选举权,各级政府的主要政务官员必须通过定期的竞选产生。<br /> (4)尊重多数人的决定,同时保护少数人的基本人权。<br /> 一句话,民主使政府成为"民有,民治,民享"的现代公器。<br /> * 宪政:宪政是通过法律规定和法治来保障宪法确定的公民基本自由和权利的原则,限制并划定政府权力和行为的边界,并提供相应的制度设施。<br /><br />在中国,帝国皇权的时代早已一去不复返了;在世界范围内,威权体制也日近黄昏;公民应该成为真正的国家主人。祛除依赖"明君"、"清官"的臣民意识,张扬权利为本、参与为责的公民意识,实践自由,躬行民主,尊奉法治,才是中国的根本出路。<br />三、我们的基本主张<br /><br /> 藉此,我们本着负责任与建设性的公民精神对国家政制、公民权利与社会发展诸方面提出如下具体主张:<br /><br /> 1. 修改宪法:根据前述价值理念修改宪法,删除现行宪法中不符合主权在民原则的条文,使宪法真正成为人权的保证书和公共权力的许可状,成为任何个人、团体和党派不得违反的可以实施的最高法律,为中国民主化奠定法权基础。<br /> 2. 分权制衡:构建分权制衡的现代政府,保证立法、司法、行政三权分立。确立法定行政和责任政府的原则,防止行政权力过分扩张;政府应对纳税人负责;在中央和地方之间建立分权与制衡制度,中央权力须由宪法明确界定授权,地方实行充分自治。<br /> 3. 立法民主:各级立法机构由直选产生,立法秉持公平正义原则,实行立法民主。<br /> 4. 司法独立:司法应超越党派、不受任何干预,实行司法独立,保障司法公正;设立宪法法院,建立违宪审查制度,维护宪法权威。尽早撤销严重危害国家法治的各级党的政法委员会,避免公器私用。<br /> 5. 公器公用:实现军队国家化,军人应效忠于宪法,效忠于国家,政党组织应从军队中退出,提高军队职业化水平。包括警察在内的所有公务员应保持政治中立。消除公务员录用的党派歧视,应不分党派平等录用。<br /> 6. 人权保障:切实保障人权,维护人的尊严。设立对最高民意机关负责的人权委员会,防止政府滥用公权侵犯人权,尤其要保障公民的人身自由,任何人不受非法逮捕、拘禁、传讯、审问、处罚,废除劳动教养制度。<br /> 7. 公职选举:全面推行民主选举制度,落实一人一票的平等选举权。各级行政首长的直接选举应制度化地逐步推行。定期自由竞争选举和公民参选法定公共职务是不可剥夺的基本人权。<br /> 8. 城乡平等:废除现行的城乡二元户籍制度,落实公民一律平等的宪法权利,保障公民的自由迁徙权。<br /> 9. 结社自由:保障公民的结社自由权,将现行的社团登记审批制改为备案制。开放党禁,以宪法和法律规范政党行为,取消一党垄断执政特权,确立政党活动自由和公平竞争的原则,实现政党政治正常化和法制化。<br /> 10. 集会自由:和平集会、游行、示威和表达自由,是宪法规定的公民基本自由,不应受到执政党和政府的非法干预与违宪限制。<br /> 11. 言论自由:落实言论自由、出版自由和学术自由,保障公民的知情权和监督权。制订《新闻法》和《出版法》,开放报禁,废除现行《刑法》中的"煽动颠覆国家政权罪"条款,杜绝以言治罪。<br /> 12. 宗教自由:保障宗教自由与信仰自由,实行政教分离,宗教信仰活动不受政府干预。审查并撤销限制或剥夺公民宗教自由的行政法规、行政规章和地方性法规;禁止以行政立法管理宗教活动。废除宗教团体(包括宗教活动场所)必经登记始获合法地位的事先许可制度,代之以无须任何审查的备案制。<br /> 13. 公民教育:取消服务于一党统治、带有浓厚意识形态色彩的政治教育与政治考试,推广以普世价值和公民权利为本的公民教育,确立公民意识,倡导服务社会的公民美德。<br /> 14. 财产保护:确立和保护私有财产权利,实行自由、开放的市场经济制度,保障创业自由,消除行政垄断;设立对最高民意机关负责的国有资产管理委员会,合法有序地展开产权改革,明晰产权归属和责任者;开展新土地运动,推进土地私有化,切实保障公民尤其是农民的土地所有权。<br /> 15. 财税改革:确立民主财政和保障纳税人的权利。建立权责明确的公共财政制度构架和运行机制,建立各级政府合理有效的财政分权体系;对赋税制度进行重大改革,以降低税率、简化税制、公平税负。非经社会公共选择过程,民意机关决议,行政部门不得随意加税、开征新税。通过产权改革,引进多元市场主体和竞争机制,降低金融准入门槛,为发展民间金融创造条件,使金融体系充分发挥活力。<br /> 16. 社会保障:建立覆盖全体国民的社会保障体制,使国民在教育、医疗、养老和就业等方面得到最基本的保障。<br /> 17. 环境保护:保护生态环境,提倡可持续发展,为子孙后代和全人类负责;明确落实国家和各级官员必须为此承担的相应责任;发挥民间组织在环境保护中的参与和监督作用。<br /> 18. 联邦共和:以平等、公正的态度参与维持地区和平与发展,塑造一个负责任的大国形象。维护香港、澳门的自由制度。在自由民主的前提下,通过平等谈判与合作互动的方式寻求海峡两岸和解方案。以大智慧探索各民族共同繁荣的可能途径和制度设计,在民主宪政的架构下建立中华联邦共和国。<br /> 19. 转型正义:为历次政治运动中遭受政治迫害的人士及其家属,恢复名誉,给予国家赔偿;释放所有政治犯和良心犯,释放所有因信仰而获罪的人员;成立真相调查委员会,查清历史事件的真相,厘清责任,伸张正义;在此基础上寻求社会和解。<br /><br />四、结语<br /><br />中国作为世界大国,作为联合国安理会五个常任理事国之一和人权理事会的成员,理应为人类和平事业与人权进步做出自身的贡献。但令人遗憾的是,在当今世界的所有大国里,唯独中国还处在威权主义政治生态中,并由此造成连绵不断的人权灾难和社会危机,束缚了中华民族的自身发展,制约了人类文明的进步——这种局面必须改变!政治民主化变革不能再拖延下去。<br /><br />为此,我们本着勇于践行的公民精神,公布《零八宪章》。我们希望所有具有同样危机感、责任感和使命感的中国公民,不分朝野,不论身份,求同存异,积极参与到公民运动中来,共同推动中国社会的伟大变革,以期早日建成一个自由、民主、宪政的国家,实现国人百余年来锲而不舍的追求与梦想。<br /><br />08憲章(日本語版)<br />一、まえがき<br /><br />今年は中国立憲百年、「世界人権宣言」公布60周年、「民主の壁」誕生30周年であり、また中国政府が「市民的及び政治的権利に関する国際規約」に署名して10周年である。長い間の人権災難と困難かつ曲折に満ちた闘いの歴史の後に、目覚めた中国国民は、自由・平等・人権が人類共同の普遍的価値であり、民主・共和・憲政が現代政治の基本的制度枠組みであることを日増しにはっきりと認識しつつある。こうした普遍的価値と基本的政治制度枠組みを取り除いた「現代化」は、人の権利をはく奪し、人間性を腐らせ、人の尊厳を踏みにじる災難である。21世紀の中国がどこに向かうのか。この種の権威主義的統治下の「現代化」か?<br />それとも普遍的価値を認め、主流文明に溶け込み、民主政体を樹立するのか? それは避けることのできない選択である。<br /><br />19世紀中葉の歴史の激変は、中国の伝統的専制制度の腐敗を暴露し、中華大地の「数千年間なかった大変動」の序幕を開いた。洋務運動はうつわ面での改良を追求し、甲午戦争(日清戦争1894年)の敗戦は再び体制の時代遅れを暴露した。戊戌変法(1898年)は制度面での革新に触れたために、守旧派の残酷な鎮圧にあって失敗した。辛亥革命(1911年)は表面的には2000年余り続いた皇帝制度を埋葬し、アジアで最初の共和国を建国した。しかし、当時の内憂外患の歴史的条件に阻害され、共和政体はごく短命に終わり、専制主義が捲土重来した。うつわの模倣と制度更新の失敗は、国民に文化的病根に対する反省を促し、ついに「科学と民主」を旗印とする「五四」新文化運動がおこったが、内戦の頻発と外敵の侵入により、中国政治の民主化過程は中断された。抗日戦争勝利後の中国は再び憲政をスタートさせたが、国共内戦の結果は中国を現代版全体主義の深淵に陥れた。1949年に建国した「新中国」は、名義上は「人民共和国」だが、実際は「党の天下」であった。政権党はすべての政治・経済・社会資源を独占し、反右派闘争、大躍進、文革、六四、民間宗教および人権擁護活動弾圧など一連の人権災害を引き起こし、数千万人の命を奪い、国民と国家は甚だしい代価を支払わされた。<br /><br />20世紀後期の「改革開放」で、中国は毛沢東時代の普遍的貧困と絶対的全体主義から抜け出し、民間の富と民衆の生活水準は大幅に向上し、個人の経済的自由と社会的権利は部分的に回復し、市民社会が育ち始め、民間の人権と政治的自由への要求は日増しに高まっている。統治者も市場化と私有化の経済改革を進めると同時に、人権の拒絶から徐々に人権を認める方向に変わっている。中国政府は、1997年、1998年にそれぞれ二つの重要な国際人権規約に署名し、全国人民代表大会は2004年の憲法改正で「人権の尊重と保障」を憲法に書き込んだ。今年はまた「国家人権行動計画」を制定し、実行することを約束した。しかし、こうした政治的進歩はいままでのところほとんど紙の上にとどまっている。法律があっても法治がなく、憲法があっても憲政がなく、依然として誰もが知っている政治的現実がある。統治集団は引き続き権威主義統治を維持し、政治改革を拒絶している。そのため官僚は腐敗し、法治は実現せず、人権は色あせ、道徳は滅び、社会は二極分化し、経済は奇形的発展をし、自然環境と人文環境は二重に破壊され、国民の自由・財産・幸福追求の権利は制度的保障を得られず、各種の社会矛盾が蓄積し続け、不満は高まり続けている。とりわけ官民対立の激化と、騒乱事件の激増はまさに破滅的な制御不能に向かっており、現行体制の時代遅れは直ちに改めざるをえない状態に立ち至っている。<br />二、我々の基本理念<br /><br />中国の将来の運命を決めるこの歴史の岐路に立って、百年来の近代化の歴史を顧みたとき、下記の基本理念を再び述べる必要がある。<br /><br />自由:自由は普遍的価値の核心である。言論・出版・信仰・集会・結社・移動・ストライキ・デモ行進などの権利は自由の具体的表現である。自由が盛んでなければ、現代文明とはいえない。<br />人権:人権は国家が賜与するものではなく、すべての人が生まれながらに有する権利である。人権保障は、政府の主な目標であり、公権力の合法性の基礎であり、また「人をもって本とす」(最近の中共のスローガン「以人為本」)の内在的要求である。中国のこれまでの毎回の政治災害はいずれも統治当局が人権を無視したことと密接に関係する。人は国家の主体であり、国家は人民に奉仕し、政府は人民のために存在するのである。<br /><br />平等:ひとりひとりの人は、社会的地位・職業・性別・経済状況・人種・肌の色・宗教・政治的信条にかかわらず、その人格・尊厳・自由はみな平等である。法の下でのすべての人の平等の原則は必ず実現されなければならず、国民の社会的・経済的・文化的・政治的権利の平等の原則が実現されなければならない。<br /><br />共和:共和とはすなわち「皆がともに治め、平和的に共存する」ことである。それは権力分立によるチェック・アンド・バランスと利益均衡であり、多くの利益要素・さまざまな社会集団・多元的な文化と信条を追求する集団が、平等な参加・公平な競争・共同の政治対話の基礎の上に、平和的方法で公共の事務を処理することである。<br /><br />民主:もっとも基本的な意味は主権在民と民選政府である。民主には以下の基本的特徴がある。<br />(1)政府の合法性は人民に由来し、政治権力の源は人民である。<br />(2)政治的統治は人民の選択を経てなされる。<br />(3)国民は真正の選挙権を享有し、各級政府の主要政務官吏は必ず定期的な選挙によって選ばれなければならない。<br />(4)多数者の決定を尊重し、同時に少数者の基本的人権を尊重する。一言でいえば、民主は政府を「民有、民治、民享」の現代の公器である。<br /><br />憲政:憲政は法律と法に基づく統治により憲法が定めた国民の基本的自由と権利を保障する原則である。それは、政府の権力と行為の限界を線引きし、あわせて対応する制度的措置を提供する。<br /><br />中国では、帝国皇帝の権力の時代はすでに過去のものとなった。世界的にも、権威主義体制はすでに黄昏が近い。国民は本当の国家の主人になるべきである。「明君」、「清官」に依存する臣民意識を払いのけ、権利を基本とし参加を責任とする市民意識を広め、自由を実践し、民主を自ら行い、法の支配を順守することこそが中国の根本的な活路である。<br />三、我々の基本的主張<br /><br />そのために、我々は責任をもって、また建設的な公民精神によって国家政治制度と市民的権利および社会発展の諸問題について以下の具体的な主張をする。<br /><br /> 1. 憲法改正:前述の価値理念に基づいて憲法を改正し、現行憲法の中の主権在民原則にそぐわない条文を削除し、憲法を本当に人権の保証書および公権力への許可証にし、いかなる個人・団体・党派も違反してはならない実施可能な最高法規とし、中国の民主化の法的な基礎を固める。<br /> 2. 権力分立:権力分立の現代的政府を作り、立法・司法・行政三権分立を保証する。法に基づく行政と責任政府の原則を確立し、行政権力の過剰な拡張を防止する。政府は納税者に対して責任を持たなければならない。中央と地方の間に権力分立とチェック・アンド・バランスの制度を確立し、中央権力は必ず憲法で授権の範囲を定められなければならず、地方は充分に自治を実施する。<br /> 3. 立法民主:各級立法機関は直接選挙により選出され、立法は公平正義の原則を堅持し、立法民主を行う。<br /> 4. 司法の独立:司法は党派を超越し、いかなる干渉も受けず、司法の独立を行い、司法の公正を保障する。憲法裁判所を設立し、違憲審査制度をつくり、憲法の権威を守る。可及的速やかに国の法治を深刻に脅かす共産党の各級政法委員会を解散させ、公器の私用を防ぐ。<br /> 5. 公器公用:軍隊の国家化を実現する。軍人は憲法に忠誠を誓い、国家に忠誠を誓わなければならない。政党組織は軍隊から退出しなければならない。軍隊の職業化レベルを高める。警察を含むすべての公務員は政治的中立を守らなければならない。公務員任用における党派差別を撤廃し、党派にかかわらず平等に任用する。<br /> 6. 人権保障:人権を確実に保障し、人の尊厳を守る。最高民意機関が責任を有する人権委員会を設立し、政府が公権力を乱用して人権を侵害することを防ぐ。とりわけ国民の人身の自由は保障されねばならず、何人も不法な逮捕・拘禁・召喚・尋問・処罰を受けない。労働教養制度(行政罰としての懲役)を廃止する。<br /> 7. 公職選挙:全面的に民主選挙制度を実施し、一人一票の平等選挙を実現する。各級行政首長の直接選挙は制度化され段階的に実施されなければならない。定期的な自由競争選挙と法定の公職への国民の選挙参加は奪うことのできない基本的人権である。<br /> 8. 都市と農村の平等:現行の都市と農村二元戸籍制度を廃止し、国民一律平等の憲法上の権利を実現し、国民の移動の自由の権利を保障する。<br /> 9. 結社の自由:国民の結社の自由権を保障し、現行の社団登記許可制を届出制に改める。結社の制限を撤廃し、憲法と法律により政党の行為を定め、一党独占の統治特権を廃止し、政党活動の自由と公平競争の原則を確立し、政党政治の正常化と法制化を実現する。<br /> 10. 集会の自由:平和的集会・デモ・示威行動など表現の自由は、憲法の定める国民の基本的自由であり、政権党と政府は不法な干渉や違憲の制限を加えてはならない。<br /> 11. 言論の自由:言論の自由・出版の自由・学術研究の自由を実現し、国民の知る権利と監督権を保障する。「新聞法」と「出版法」を制定し、報道の制限を撤廃し、現行「刑法」中の「国家政権転覆扇動罪」条項を廃止し、言論の処罰を根絶する。<br /> 12. 宗教の自由:宗教の自由と信仰の自由を保障する。政教分離を実施し、宗教活動が政府の干渉を受けないようにする。国民の宗教的自由を制限する行政法規・行政規則・地方法規を審査し撤廃する。行政が立法により宗教活動を管理することを禁止する。宗教団体(宗教活動場所を含む)は登記されて初めて合法的地位を獲得するという事前許可制を撤廃し、これに代えていかなる審査も必要としない届出制とする。<br /> 13. 国民教育:一党統治への奉仕や濃厚なイデオロギー的色彩の政治教育と政治試験を廃止し、普遍的価値と市民的権利を基本とする国民教育を推進し、国民意識を確立し、社会に奉仕する国民の美徳を提唱する。<br /> 14. 財産の保護:私有財産権を確立し保護する。自由で開かれた市場経済制度を行い、創業の自由を保障し、行政による独占を排除する。最高民意機関が責任を有する国有資産管理委員会を設立し、合法的に秩序立って財産権改革を進め、財産権の帰属と責任者を明確にする。新土地運動を展開し、土地の私有化を推進し、国民とりわけ農民の土地所有権を確実に保障する。<br /> 15. 財税改革:財政民主主義を確立し納税者の権利を保障する。権限と責任の明確な公共財政制度の枠組みと運営メカニズムを構築し、各級政府の合理的な財政分権体系を構築する。税制の大改革を行い、税率を低減し、税制を簡素化し、税負担を公平化する。公共選択や民意機関の決議を経ずに、行政部門は増税・新規課税を行ってはならない。財産権改革を通じて、多元的市場主体と競争メカニズムを導入し、金融参入の敷居を下げ、民間金融の発展に条件を提供し、金融システムの活力を充分に発揮させる。<br /> 16. 社会保障:全国民をカバーする社会保障制度を構築し、国民の教育・医療・養老・就職などの面でだれもが最も基本的な保障を得られるようにする。<br /> 17. 環境保護:生態環境を保護し、持続可能な開発を提唱し、子孫と全人類に責任を果たす。国家と各級官吏は必ずそのために相応の責任を負わなければならないことを明確にする。民間組織の環境保護における参加と監督作用を発揮させる。<br /> 18. 連邦共和:平等・公正の態度で地区の平和と発展を維持し、責任ある大国のイメージを作る。香港・マカオの自由制度を維持する。自由民主の前提のもとに、平等な協議と相互協力により海峡両岸の和解案を追求する。大きな知恵で各民族の共同の繁栄が可能な道と制度設計を探求し、立憲民主制の枠組みの下で中華連邦共和国を樹立する。<br /> 19. 正義の転換:これまでの度重なる政治運動で政治的迫害を受けた人々とその家族の名誉を回復し、国家賠償を行う。すべての政治犯と良心の囚人を釈放する。すべての信仰により罪に問われた人々を釈放する。真相調査委員会を設立し歴史的事件の真相を解明し、責任を明らかにし、正義を鼓舞する。それを基礎として社会の和解を追求する。<br /><br />四、結語<br /><br />中国は世界の大国として、国連安全保障理事会の5つの常任理事国の一つとしてまた人権理事会のメンバーとして、人類の平和事業と人権の進歩のために貢献すべきである。しかし遺憾なことに、今日の世界のすべての大国の中で、ただ中国だけがいまだに権威主義の政治の中にいる。またそのために絶え間なく人権災害と社会危機が発生しており、中華民族の発展を縛り、人類文明の進歩を制約している。このような局面は絶対に改めねばならない!<br Link, Professor<br />of Chinese Literature at the University of California, Riverside, will<br />be published in the issue of The New York Review dated January 15,<br />which goes on sale on January 2.<br />—The Editors<br /><br />The document below, signed by over three hundred prominent Chinese<br />citizens, was conceived and written in conscious admiration of the<br />founding of Charter 77 in Czechoslovakia, where, in January 1977, more<br />than two hundred Czech and Slovak intellectuals formed a<br /><br />loose, informal, and open association of people... united by the will<br />to strive individually and collectively for respect for human and<br />civil rights in our country and throughout the world.<br /><br />The Chinese document calls not for ameliorative reform of the current<br />political system but for an end to some of its essential features,<br />including one-party rule, and their replacement with a system based on<br />human rights and democracy.<br /><br />The prominent citizens who have signed the document are from both<br />outside and inside the government, and include not only well-known<br />dissidents and intellectuals, but also middle-level officials and<br />rural leaders. They have chosen December 10, the anniversary of the<br />Universal Declaration of Human Rights, as the day on which to express<br />their political ideas and to outline their vision of a constitutional,<br />democratic China. They intend "Charter 08" to serve as a blueprint for<br />fundamental political change in China in the years to come. The<br />signers of the document will form an informal group, open-ended in<br />size but united by a determination to promote democratization and<br />protection of human rights in China and beyond.<br /><br />On December 8 two prominent signers of the Charter, Zhang Zuhua and<br />Liu Xiaobo, were detained by the police. Zhang Zuhua has since been<br />released; as of December 9, Liu Xiabo remains in custody.<br />—Perry Link<br />Frederick Douglass Book Prize Announcement<br />I. Foreword<br /><br />A hundred years have passed since the writing of China's first<br />constitution. 2008 also marks the sixtieth anniversary of the<br />promulgation of the Universal Declaration of Human Rights, the<br />thirtieth anniversary of the appearance of Democracy Wall in Beijing,<br />and the tenth of China's signing of the International Covenant on<br />Civil and Political Rights. We are approaching the twentieth<br />anniversary of the 1989 Tiananmen massacre of pro-democracy student<br />protesters. The Chinese people, who have endured human rights<br />disasters and uncountable struggles across these same years, now<br />include many who see clearly that freedom, equality, and human rights<br />are universal values of humankind and that democracy and<br />constitutional government are the fundamental framework for protecting<br />these values.<br /><br />By departing from these values, the Chinese government's approach to<br />"modernization" has proven disastrous. It has stripped people of their<br />rights, destroyed their dignity, and corrupted normal human<br />intercourse. So we ask: Where is China headed in the twenty-first<br />century? Will it continue with "modernization" under authoritarian<br />rule, or will it embrace universal human values, join the mainstream<br />of civilized nations, and build a democratic system? There can be no<br />avoiding these questions.<br /><br />The shock of the Western impact upon China in the nineteenth century<br />laid bare a decadent authoritarian system and marked the beginning of<br />what is often called "the greatest changes in thousands of years" for<br />China. A "self-strengthening movement" followed, but this aimed simply<br />at appropriating the technology to build gunboats and other Western<br />material objects. China's humiliating naval defeat at the hands of<br />Japan in 1895 only confirmed the obsolescence of China's system of<br />government. The first attempts at modern political change came with<br />the ill-fated summer of reforms in 1898, but these were cruelly<br />crushed by ultraconservatives at China's imperial court. With the<br />revolution of 1911, which inaugurated Asia's first republic, the<br />authoritarian imperial system that had lasted for centuries was<br />finally supposed to have been laid to rest. But social conflict inside<br />our country and external pressures were to prevent it; China fell into<br />a patchwork of warlord fiefdoms and the new republic became a fleeting<br />dream.<br /><br />The failure of both "self-strengthening" and political renovation<br />caused many of our forebears to reflect deeply on whether a "cultural<br />illness" was afflicting our country. This mood gave rise, during the<br />May Fourth Movement of the late 1910s, to the championing of "science<br />and democracy." Yet that effort, too, foundered as warlord chaos<br />persisted and the Japanese invasion [beginning in Manchuria in 1931]<br />brought national crisis.<br /><br />Victory over Japan in 1945 offered one more chance for China to move<br />toward modern government, but the Communist defeat of the Nationalists<br />in the civil war thrust the nation into the abyss of totalitarianism.<br />The "new China" that emerged in 1949 proclaimed that "the people are<br />sovereign" but in fact set up a system in which "the Party is<br />all-powerful." The Communist Party of China seized control of all<br />organs of the state and all political, economic, and social resources,<br />and, using these, has produced a long trail of human rights disasters,<br />including, among many others, the Anti-Rightist Campaign (1957), the<br />Great Leap Forward (1958–1960), the Cultural Revolution (1966–1969),<br />the June Fourth (Tiananmen Square) Massacre (1989), and the current<br />repression of all unauthorized religions and the suppression of the<br />weiquan rights movement [a movement that aims to defend citizens'<br />rights promulgated in the Chinese Constitution and to fight for human<br />rights recognized by international conventions that the Chinese<br />government has signed]. During all this, the Chinese people have paid<br />a gargantuan price. Tens of millions have lost their lives, and<br />several generations have seen their freedom, their happiness, and<br />their human dignity cruelly trampled.<br /><br />During the last two decades of the twentieth century the government<br />policy of "Reform and Opening" gave the Chinese people relief from the<br />pervasive poverty and totalitarianism of the Mao Zedong era and<br />brought substantial increases in the wealth and living standards of<br />many Chinese as well as a partial restoration of economic freedom and<br />economic rights. Civil society began to grow, and popular calls for<br />more rights and more political freedom have grown apace. As the ruling<br />elite itself moved toward private ownership and the market economy, it<br />began to shift from an outright rejection of "rights" to a partial<br />acknowledgment of them.<br /><br />In 1998 the Chinese government signed two important international<br />human rights conventions; in 2004 it amended its constitution to<br />include the phrase "respect and protect human rights"; and this year,<br />2008, it has promised to promote a "national human rights action<br />plan." Unfortunately most of this political progress has extended no<br />further than the paper on which it is written. The political reality,<br />which is plain for anyone to see, is that China has many laws but no<br />rule of law; it has a constitution but no constitutional government.<br />The ruling elite continues to cling to its authoritarian power and<br />fights off any move toward political change.<br /><br />The stultifying results are endemic official corruption, an<br />undermining of the rule of law, weak human rights, decay in public<br />ethics, crony capitalism, growing inequality between the wealthy and<br />the poor, pillage of the natural environment as well as of the human<br />and historical environments, and the exacerbation of a long list of<br />social conflicts, especially, in recent times, a sharpening animosity<br />between officials and ordinary people.<br /><br />As these conflicts and crises grow ever more intense, and as the<br />ruling elite continues with impunity to crush and to strip away the<br />rights of citizens to freedom, to property, and to the pursuit of<br />happiness, we see the powerless in our society—the vulnerable groups,<br />the people who have been suppressed and monitored, who have suffered<br />cruelty and even torture, and who have had no adequate avenues for<br />their protests, no courts to hear their pleas—becoming more militant<br />and raising the possibility of a violent conflict of disastrous<br />proportions. The decline of the current system has reached the point<br />where change is no longer optional.<br />II. Our Fundamental Principles<br /><br />This is a historic moment for China, and our future hangs in the<br />balance. In reviewing the political modernization process of the past<br />hundred years or more, we reiterate and endorse basic universal values<br />as follows:<br /><br />Freedom. Freedom is at the core of universal human values. Freedom of<br />speech, freedom of the press, freedom of assembly, freedom of<br />association, freedom in where to live, and the freedoms to strike, to<br />demonstrate, and to protest, among others, are the forms that freedom<br />takes. Without freedom, China will always remain far from civilized<br />ideals.<br /><br />Human rights. Human rights are not bestowed by a state. Every person<br />is born with inherent rights to dignity and freedom. The government<br />exists for the protection of the human rights of its citizens. The<br />exercise of state power must be authorized by the people. The<br />succession of political disasters in China's recent history is a<br />direct consequence of the ruling regime's disregard for human rights.<br /><br />Equality. The integrity, dignity, and freedom of every<br />person—regardless of social station, occupation, sex, economic<br />condition, ethnicity, skin color, religion, or political belief—are<br />the same as those of any other. Principles of equality before the law<br />and equality of social, economic, cultural, civil, and political<br />rights must be upheld.<br /><br />Republicanism. Republicanism, which holds that power should be<br />balanced among different branches of government and competing<br />interests should be served, resembles the traditional Chinese<br />political ideal of "fairness in all under heaven." It allows different<br />interest groups and social assemblies, and people with a variety of<br />cultures and beliefs, to exercise democratic self-government and to<br />deliberate in order to reach peaceful resolution of public questions<br />on a basis of equal access to government and free and fair<br />competition.<br /><br />Democracy. The most fundamental principles of democracy are that the<br />people are sovereign and the people select their government. Democracy<br />has these characteristics:<br />(1) Political power begins with the people and the legitimacy of a<br />regime derives from the people.<br />(2) Political power is exercised through choices that the people make.<br />(3) The holders of major official posts in government at all levels<br />are determined through periodic competitive elections.<br />(4) While honoring the will of the majority, the fundamental dignity,<br />freedom, and human rights of minorities are protected. In short,<br />democracy is a modern means for achieving government truly "of the<br />people, by the people, and for the people."<br /><br />Constitutional rule. Constitutional rule is rule through a legal<br />system and legal regulations to implement principles that are spelled<br />out in a constitution. It means protecting the freedom and the rights<br />of citizens, limiting and defining the scope of legitimate government<br />power, and providing the administrative apparatus necessary to serve<br />these ends.<br />III. What We Advocate<br /><br />Authoritarianism is in general decline throughout the world; in China,<br />too, the era of emperors and overlords is on the way out. The time is<br />arriving everywhere for citizens to be masters of states. For China<br />the path that leads out of our current predicament is to divest<br />ourselves of the authoritarian notion of reliance on an "enlightened<br />overlord" or an "honest official" and to turn instead toward a system<br />of liberties, democracy, and the rule of law, and toward fostering the<br />consciousness of modern citizens who see rights as fundamental and<br />participation as a duty. Accordingly, and in a spirit of this duty as<br />responsible and constructive citizens, we offer the following<br />recommendations on national governance, citizens' rights, and social<br />development:<br /><br /> 1. A New Constitution. We should recast our present constitution,<br />rescinding its provisions that contradict the principle that<br />sovereignty resides with the people and turning it into a document<br />that genuinely guarantees human rights, authorizes the exercise of<br />public power, and serves as the legal underpinning of China's<br />democratization. The constitution must be the highest law in the land,<br />beyond violation by any individual, group, or political party.<br /> 2. Separation of powers. We should construct a modern government in<br />which the separation of legislative, judicial, and executive power is<br />guaranteed. We need an Administrative Law that defines the scope of<br />government responsibility and prevents abuse of administrative power.<br />Government should be responsible to taxpayers. Division of power<br />between provincial governments and the central government should<br />adhere to the principle that central powers are only those<br />specifically granted by the constitution and all other powers belong<br />to the local governments.<br /> 3. Legislative democracy. Members of legislative bodies at all<br />levels should be chosen by direct election, and legislative democracy<br />should observe just and impartial principles.<br /> 4. An Independent Judiciary. The rule of law must be above the<br />interests of any particular political party and judges must be<br />independent. We need to establish a constitutional supreme court and<br />institute procedures for constitutional review. As soon as possible,<br />we should abolish all of the Committees on Political and Legal Affairs<br />that now allow Communist Party officials at every level to decide<br />politically-sensitive cases in advance and out of court. We should<br />strictly forbid the use of public offices for private purposes.<br /> 5. Public Control of Public Servants. The military should be made<br />answerable to the national government, not to a political party, and<br />should be made more professional. Military personnel should swear<br />allegiance to the constitution and remain nonpartisan. Political party<br />organizations shall be prohibited in the military. All public<br />officials including police should serve as nonpartisans, and the<br />current practice of favoring one political party in the hiring of<br />public servants must end.<br /> 6. Guarantee of Human Rights. There shall be strict guarantees of<br />human rights and respect for human dignity. There should be a Human<br />Rights Committee, responsible to the highest legislative body, that<br />will prevent the government from abusing public power in violation of<br />human rights. A democratic and constitutional China especially must<br />guarantee the personal freedom of citizens. No one shall suffer<br />illegal arrest, detention, arraignment, interrogation, or punishment.<br />The system of "Reeducation through Labor" must be abolished.<br /> 7. Election of Public Officials. There shall be a comprehensive<br />system of democratic elections based on "one person, one vote." The<br />direct election of administrative heads at the levels of county, city,<br />province, and nation should be systematically implemented. The rights<br />to hold periodic free elections and to participate in them as a<br />citizen are inalienable.<br /> 8. Rural–Urban Equality. The two-tier household registry system<br />must be abolished. This system favors urban residents and harms rural<br />residents. We should establish instead a system that gives every<br />citizen the same constitutional rights and the same freedom to choose<br />where to live.<br /> 9. Freedom to Form Groups. The right of citizens to form groups<br />must be guaranteed. The current system for registering nongovernment<br />groups, which requires a group to be "approved," should be replaced by<br />a system in which a group simply registers itself. The formation of<br />political parties should be governed by the constitution and the laws,<br />which means that we must abolish the special privilege of one party to<br />monopolize power and must guarantee principles of free and fair<br />competition among political parties.<br /> 10. Freedom to Assemble. The constitution provides that peaceful<br />assembly, demonstration, protest, and freedom of expression are<br />fundamental rights of a citizen. The ruling party and the government<br />must not be permitted to subject these to illegal interference or<br />unconstitutional obstruction.<br /> 11. Freedom of Expression. We should make freedom of speech, freedom<br />of the press, and academic freedom universal, thereby guaranteeing<br />that citizens can be informed and can exercise their right of<br />political supervision. These freedoms should be upheld by a Press Law<br />that abolishes political restrictions on the press. The provision in<br />the current Criminal Law that refers to "the crime of incitement to<br />subvert state power" must be abolished. We should end the practice of<br />viewing words as crimes.<br /> 12. Freedom of Religion. We must guarantee freedom of religion and<br />belief and institute a separation of religion and state. There must be<br />no governmental interference in peaceful religious activities. We<br />should abolish any laws, regulations, or local rules that limit or<br />suppress the religious freedom of citizens. We should abolish the<br />current system that requires religious groups (and their places of<br />worship) to get official approval in advance and substitute for it a<br />system in which registry is optional and, for those who choose to<br />register, automatic.<br /> 13. Civic Education. In our schools we should abolish political<br />curriculums and examinations that are designed to indoctrinate<br />students in state ideology and to instill support for the rule of one<br />party. We should replace them with civic education that advances<br />universal values and citizens' rights, fosters civic consciousness,<br />and promotes civic virtues that serve society.<br /> 14. Protection of Private Property. We should establish and protect<br />the right to private property and promote an economic system of free<br />and fair markets. We should do away with government monopolies in<br />commerce and industry and guarantee the freedom to start new<br />enterprises. We should establish a Committee on State-Owned Property,<br />reporting to the national legislature, that will monitor the transfer<br />of state-owned enterprises to private ownership in a fair,<br />competitive, and orderly manner. We should institute a land reform<br />that promotes private ownership of land, guarantees the right to buy<br />and sell land, and allows the true value of private property to be<br />adequately reflected in the market.<br /> 15. Financial and Tax Reform. We should establish a democratically<br />regulated and accountable system of public finance that ensures the<br />protection of taxpayer rights and that operates through legal<br />procedures. We need a system by which public revenues that belong to a<br />certain level of government—central, provincial, county or local—are<br />controlled at that level. We need major tax reform that will abolish<br />any unfair taxes, simplify the tax system, and spread the tax burden<br />fairly. Government officials should not be able to raise taxes, or<br />institute new ones, without public deliberation and the approval of a<br />democratic assembly. We should reform the ownership system in order to<br />encourage competition among a wider variety of market participants.<br /> 16. Social Security. We should establish a fair and adequate social<br />security system that covers all citizens and ensures basic access to<br />education, health care, retirement security, and employment.<br /> 17. Protection of the Environment. We need to protect the natural<br />environment and to promote development in a way that is sustainable<br />and responsible to our descendents and to the rest of humanity. This<br />means insisting that the state and its officials at all levels not<br />only do what they must do to achieve these goals, but also accept the<br />supervision and participation of non-governmental organizations.<br /> 18. A Federated Republic. A democratic China should seek to act as a<br />responsible major power contributing toward peace and development in<br />the Asian Pacific region by approaching others in a spirit of equality<br />and fairness. In Hong Kong and Macao, we should support the freedoms<br />that already exist. With respect to Taiwan, we should declare our<br />commitment to the principles of freedom and democracy and then,<br />negotiating as equals, and ready to compromise, seek a formula for<br />peaceful unification. We should approach disputes in the<br />national-minority areas of China with an open mind, seeking ways to<br />find a workable framework within which all ethnic and religious groups<br />can flourish. We should aim ultimately at a federation of democratic<br />communities of China.<br /> 19. Truth in Reconciliation. We should restore the reputations of<br />all people, including their family members, who suffered political<br />stigma in the political campaigns of the past or who have been labeled<br />as criminals because of their thought, speech, or faith. The state<br />should pay reparations to these people. All political prisoners and<br />prisoners of conscience must be released. There should be a Truth<br />Investigation Commission charged with finding the facts about past<br />injustices and atrocities, determining responsibility for them,<br />upholding justice, and, on these bases, seeking social reconciliation.<br /><br />China, as a major nation of the world, as one of five permanent<br />members of the United Nations Security Council, and as a member of the<br />UN Council on Human Rights, should be contributing to peace for<br />humankind and progress toward human rights. Unfortunately, we stand<br />today as the only country among the major nations that remains mired<br />in authoritarian politics. Our political system continues to produce<br />human rights disasters and social crises, thereby not only<br />constricting China's own development but also limiting the progress of<br />all of human civilization. This must change, truly it must. The<br />democratization of Chinese politics can be put off no longer.<br /><br />Accordingly, we dare to put civic spirit into practice by announcing<br />Charter 08. We hope that our fellow citizens who feel a similar sense<br />of crisis, responsibility, and mission, whether they are inside the<br />government or not, and regardless of their social status, will set<br />aside small differences to embrace the broad goals of this citizens'<br />movement. Together we can work for major changes in Chinese society<br />and for the rapid establishment of a free, democratic, and<br />constitutional country. We can bring to reality the goals and ideals<br />that our people have incessantly been seeking for more than a hundred<br />years, and can bring a brilliant new chapter to Chinese civilization.<br /><br />—translated from the Chinese by Perry Link<br /><br />it's translated by jordan pouille (Canadian Right and Democracy )<br />08 de la Charte (en français)法文版<br /><br />Introduction<br /><br />"Cent ans ont passé depuis la rédaction de la première constitution<br />chinoise. 2008 marque également le 60ème anniversaire de la<br />déclaration universelle des droits de l'homme, le 30ème anniversaire<br />de l'apparition du "Mur de la démocratie" à Pékin, et le 10ème<br />anniversaire de la signature par la Chine du Pacte international des<br />droits civiques et politiques [des Nations Unies, ndlr].<br /><br />Nous approchons également du 20ème anniversaire du massacre des<br />manifestants étudians favorables à la démocratie sur la place<br />Tiananmen.<br /><br />Le peuple chinois, qui endure un désastre en matière de droits de<br />l'homme et a mené d'innombrables luttes au fil de ces années, voit<br />clairement que la liberté, l'égalité, et les droits de l'homme, sont<br />des valeurs universelles de l'humanité, et que la démocratie et un<br />gouvernement constitutionnel constituent un cadre fondamental pour<br />préserver ces valeurs.<br /><br />En s'éloignant de ces valeurs, l'approche du gouvernement chinois<br />vis-à-vis de la "modernisation" s'est révélé désastreuse. Elle a privé<br />le peuple de ses droits, détruit sa dignité et corrompu le cours<br />normal des relations humaines.<br /><br />Alors nous posons la question: où va la Chine au XXIème siècle?<br />Poursuivra-t-elle sa "modernisation" autoritaire, ou épousera-t-elle<br />les valeurs universelles, rejoindra-t-elle le lot commun des nations<br />civilisées et bâtira-t-elle un système démocratique ? Il n'est pas<br />possible d'éluder ces questions.<br /><br />Le choc de la rencontre avec l'Occident sur la Chine du XIX° siècle a<br />mis à nu le système autoritaire décadent et marqué le début de ce<br />qu'on appelle généralement "les plus grands changements qu'ait connu<br />la Chine en plusieurs millénaires". Un mouvement d'auto-renforcement"<br />a suivi, mais qui avait surtout pour objectif de récupérer les<br />technologies permettant de fabriquer des navires de guerre et autres<br />objets occidentaux. La défaite maritime humiliante de la Chine face au<br />Japon en 1895 n'a fait que confirmer l'obsololescence du système<br />chinois.<br /><br />Les premières tentatives d'introduire des réformes politiques ont eu<br />lieu lors des malheureuses réformes de l'été 1898, mais celles-ci ont<br />été écrasées sans ménagement par les ultraconservateurs au sein de la<br />cour impériale.<br /><br />Avec la révolution de 1911, qui a permis de créer la première<br />République d'Asie, le système autoritaire impérial vieux de plusieurs<br />siècles était censé avoir été envoyé aux oubliettes pour l'éternité.<br />Mais le conflit social à l'intérieur de notre pays, ainsi que les<br />pressions extérieures, ont empêché qu'il en soit ainsi: la Chine se<br />divise en fiefs de seigneurs de la guerre et le rêve de la République<br />s'évanouit.<br /><br />Le double échec de ce "mouvement d'auto-renforcement" et de la<br />rénovation politique ont amené nos ancêtres à se poser la question<br />d'une éventuelle "maladie culturelle" qui aurait frappé notre pays. Ce<br />questionnement donna naissance, lors du mouvement du 4 mai à la fin<br />des années 1910, au courant exaltant "la science et la démocratie".<br />Mais cette tentative échoua elle-aussi, sous les coups de butoir des<br />seigneurs de la guerre et de l'invasion japonaise [à partir de 1931 en<br />Mandchourie] provoquant une crise nationale.<br /><br />La victoire sur le Japon, en 1945, donna une nouvelle chance à la<br />Chine d'évoluer vers un gouvernement moderne, mais la victoire<br />communiste sur les Nationalistes lors de la guerre civile plongea la<br />Chine dans le totalitarisme. La "nouvelle Chine" née en 1949 proclama<br />que "le peuple est souverain", mais mit en place un système dans<br />lequel c'est le Parti qui est tout puissant.<br /><br />Le Parti communiste chinois prit le contrôle de tous les organes de<br />l'Etat, toutes les ressources économiques, politiques et sociales du<br />pays, et a provoqué une longue succession de désastres sur le plan des<br />droits de l'homme, y compris la "campagne anti-droitiers" (1957), le<br />"Grand bond en avant" (1958-1960), la "révolution culturelle"<br />(1966-1969), le "massacre du 4 juin (Tiananmen)" (1989), ainsi que la<br />répression actuelle de toutes les religions non-autorisées, la<br />suppression du mouvement "weiquan" [mouvement de défense des droits<br />civiques tels qu'énoncés dans la constitution chinoise et dans le<br />Protocole de l'ONU signé par le gouvernement chinois, ndlr].<br /><br />Pendant toute cette période, le peuple chinois a payé un prix<br />colossal. Des dizaines de millions de personnes ont perdu leur vie, et<br />plusieurs générations ont vu leur liberté, leur bonheur, leur dignité<br />humaine cruellement foulés aux pieds.<br /><br />Au cours des deux dernières décennies du XX° siècle, la politique de<br />"réforme et ouverture" du gouvernement a soulagé le peuple des effets<br />de la pauvreté et du totalitarisme de l'ère de Mao Zedong, et a eu<br />pour effet d'améliorer le niveau de richesse et les conditions de vie<br />de nombreux Chinois, ainsi que le rétablissement partiel de la liberté<br />économique et des droits économiques.<br /><br />La société civile a commencé à se développer, et les appels en faveur<br />de plus de droits et de libertés politiques se sont également<br />multipliés. Alors que l'élite au pouvoir a elle-même opéré un<br />glissement vers la propriété privée et l'économie de marché, elle est<br />progressivement passée d'un refus absolu de tout "droit", à la<br />reconnaissance partielle de ceux-ci.<br /><br />En 1988, le gouvernement chinois a signé deux importants pactes<br />internationaux sur les droits de l'homme; en 2004, il a amendé la<br />Constitution pour y inclure la phrase "respecter et protéger les<br />droits de l'homme"; et cette année, en 2008, il s'est engagé à<br />promouvoir un "plan national d'action en faveur des droits de<br />l'homme".<br /><br />Hélas, la majeure partie de ces progrès politiques ne sont pas allés<br />plus loin que le papier sur lequel ils étaient écrits. La réalité, qui<br />est visible à l'oeil nu, est que la Chine a de nombreuses lois mais<br />pas d'Etat de droit, elle a une Constitution mais pas de gouvernement<br />constitutionnel. L'élite au pouvoir continue de s'accrocher à son<br />pouvoir autoritaire et à repousser toute évolution vers des<br />changements politiques.<br /><br />Le résultat est une corruption officielle endémique, un<br />affaiblissement de tout Etat de droit, des droits de l'homme faibles,<br />l'effondrement de toute éthique publique, un capitalisme de copinage,<br />des inégalités croissantes entre riches et pauvres, le pillage des<br />ressources naturelles, ainsi que de notre environnement historique et<br />humain, et l'exacerbation d'une longue liste de conflits sociaux, y<br />compris, dans la dernière période, une animosité croissante entre les<br />gens ordinaires et les officiels.<br /><br />Alors que ces conflits et ces crises gagnent en intensité, alors que<br />l'élite au pouvoir continue à écraser et à bafouer en toute impunité<br />les droits des citoyens à la liberté, à la propriété et à la quête du<br />bonheur, nous assistons à une radicalisation de ceux qui n'ont pas de<br />pouvoir au sein de la société: les groupes vulnérables, les groupes<br />qui ont été réprimés, qui ont cruellement souffert, y compris de la<br />torture, et qui n'ont aucun espace pour protester, aucun tribunal pour<br />entendre leur plainte.<br /><br />Ces groupes sont de plus en plus militants, et laissent entrevoir la<br />possibilté d'un conflit violent pouvant prendre des proportions<br />désastreuses. Le déclin du système actuel a atteint un niveau auquel<br />le changement ne peut pas être une simple option.<br />Nos principes fondamentaux<br /><br />C'est un moment historique pour la Chine, et notre avenir est en<br />suspens. En revoyant le processus de modernisation politique du siècle<br />écoulé, nous réaffirmons et acceptons les valeurs universelles de base<br />qui suivent:<br /><br /> * La Liberté. La liberté est au centre des valeurs humaines<br />universelles. La liberté d'expression, la liberté de la presse, la<br />liberté de se réunir, la liberté d'association, la liberté du lieu de<br />résidence, la liberté de faire grève, de manifester, de protester,<br />font partie des formes que prend la liberté. Sans liberté, la Chine<br />restera éternellement éloignée des idéaux civilisés.<br /> * Les droits de l'homme. Les droits de l'homme ne sont pas<br />octroyés par un Etat. Toute personne nait avec son droit inhérent à la<br />liberté et à la dignité. Le gouvernement existe pour assurer la<br />protection des droits de l'homme de ses citoyens. L'exercice du<br />pouvoir de l'Etat doit être autorisé par le peuple. La succession de<br />désastres politiques dans l'histoire récente de la Chine est une<br />conséquence directe du manque de restect du régime actuel pour les<br />droits de l'homme.<br /> * L'égalité. L'intégrité, la dignité et la liberté de toute<br />personne -quelle que soit sa situation sociale, sa profession, son<br />sexe, sa condition économique, son origine ethnique, la couleur de sa<br />peau, sa religion ou ses convictions politiques- doivent être les<br />mêmes pour tous. Le principe d'égalité devant la loi, et l'égalité des<br />droits sociaux, économiques, culturels, civiques et politiques, doit<br />être respecté.<br /> * Le Républicanisme. Le Républicanisme, qui prône que le pouvoir<br />soit équilibré entre ls différentes branches du gouvernement et les<br />intérêts différents, doit être respecté. Il s'approche du concept<br />politique traditionnel chinois qui estime que "tous sont égaux sous le<br />ciel".<br /> * Il permet à tous les groupes d'intérêt et aux assemblées<br />sociales, aux gens de cultures ou de croyance différentes, d'exercer<br />leur propre gouvernement de manière démocratique, et de délibérer pour<br />parvenir à des solutions pacifiques à toutes les questions d'intérêt<br />public, sur la base d'un accès égal au gouvernement, et d'une<br />concurrence libre et honnête.<br /> * La Démocratie. Les principes fondamentaux essentiels de la<br />démocratie sont que le peuple est souverain et qu'il choisit son<br />gouvernement. La Démocratie a les caractéristiques suivantes:<br /> 1) le pouvoir politique est issu du peuple, et la légitimité<br />d'un régime vient du peuple;<br /> 2) Le pouvoir politique est exercé à travers les choix faits par<br />le peuple;<br /> 3) Les détenteurs des principales fonctions officielles au sein<br />du gouvernement sont déterminés dans des élections régulières et<br />ouvertes à la concurrence;<br /> 4) Tout en respectant la volonté de la majorité, la dignité<br />fondamentale, la liberté et les droits de l'homme des minorités sont<br />protégés.<br /> En d'autres termes, la démocratie est le moyen moderne de<br />parvenir au "pouvoir du peuple, par le peuple et pour le peuple".<br /><br />Ce que nous préconisons<br /><br />L'autoritarisme est en déclin dans le monde. En Chine aussi, le<br />pouvoir des empereurs et des seigneurs est en train de s'achever. Il<br />est temps de faire que partout les citoyens soient les maîtres de<br />leurs Etats.<br /><br />Pour la Chine, le chemin qui conduit vers la sortie de notre sort<br />actuel est de nous libérer du concept autoritaire de la dépendance<br />vis-à-vis d'un "seigneur éclairé" ou d'un "officiel honnête", et de<br />nous tourner vers un système de liberté, de démocratie, d'Etat de<br />droit, et vers l'émergence d'une conscience de citoyens modernes pour<br />qui les droits sont fondamentaux, et la participation un devoir.<br /><br />Dès lors, dans cet esprit de devoir en tant que citoyens constructifs<br />et responsables, nous faisons les recommandations suivantes sur la<br />gouvernance nationale, les droits des ditoyens, et le développement<br />social:<br /><br /> 1. Une nouvelle Constitution Nous devons réviser notre Constitution<br />actuelle, en retirer les clauses qui contredisent le principe selon<br />lequel la souveraineté est détenue par le peuple. Et nous devons la<br />transformer en un document qui garantisse véritablement les droits de<br />l'homme, autorise l'exercice du pouvoir public, et serve de cadre<br />légal à la démocratisation de la Chine. La Constitution doit être la<br />loi suprême du pays, ne pouvant être violée par tout individu, groupe<br />ou parti politique.<br /> 2. La séparation des pouvoirs Nous devons bâtir un système moderne<br />de gouvernement dans lequel la séparation des pouvoirs exécutif,<br />législatif et judiciaire soit garantie. Nous avons besoin d'une Loi<br />administrative qui définisse l'étendue des responsabilités du<br />gouvernement et garantisse contre les abus de pouvoir administratifs.<br />Le gouvernement doit être responsable devant les contribuables.<br /> La division des pouvoirs entre les gouvernements des provinces<br />et le gouvernement central devrait respecter le principe selon lequel<br />le gouvernement central détient tous les pouvoirs qui lui sont<br />spécifiquement conférés par la Constitution, et tous les autres<br />appartiennent aux gouvernements locaux.<br /> 3. Une démocratie législative Les membres des organes législatifs à<br />tous les niveaux devraient être choisis dans des élections directes,<br />et la démocratie parlementaire devrait respecter des principes justes<br />et impartiaux.<br /> 4. Une magistrature indépendante L'Etat de droit doit être<br />au-dessus des intérêts d'un parti politique particulier, et les juges<br />doivent être indépendants. Nous devons créer une Cour suprême<br />constitutionnelle et créer des procédures d'examen le plus rapidement<br />possible. Nous devons abolir tous les Comités politiques et légaux qui<br />permettent aujourd'hui aux cadres du Parti communiste de décider de<br />tous ls cas sensibles en dehors du cadre judiciaire. Nous devons<br />interdire formellement l'usage de fonctions publiques à des fins<br />privées.<br /> 5. Le contrôle public des fonctionnaires L'armée doit être<br />responsable devant le gouvernement, pas devant un parti politique, et<br />doit être professionnalisée. Les militaires doivent prêter serment sur<br />la Constitution et rester neutres. Les partis politiques doivent être<br />interdits dans l'armée. Tous les serviteurs de l'Etat, y compris la<br />police, doivent servir de manière non-partisane, et la pratique<br />actuelle qui consiste à favoriser un parti politique dans le<br />recrutement doit cesser.<br /> 6. La Garantie des droits de l'homme Il doit y avoir des garanties<br />strictes sur le respect des droits de l'homme et de la dignité<br />humaine. Il doit y avoir un Comité des droits de l'homme, responsable<br />devant l'organe législatif suprême du pays, qui veillera à empêcher le<br />gouvernement d'abuser de son pouvoir en matière de droits de l'homme.<br />Une Chine constitutionnelle et démocratique doit garantir la liberté<br />individuelle de ses citoyens. Personne ne doit être victime<br />d'arrestations, de détentions, d'interrogatoires ou de punitions<br />illégales. Le système de "rééducation par le travail" doit être aboli.<br /> 7. L'élection des officiels Il doit y avoir un système complet<br />d'élections démocratiques basé sur le principe "une personne, une<br />voix". L'élection directe des responsables administratifs à tous les<br />niveaux, du conté, de la ville, de la province ou du pays, doit être<br />systématisée. Le droit d'avoir des élections régulières et d'y<br />participer en tant que citoyen est inaliénable.<br /> 8. Egalité villes-campagnes Le système d'enregistrement des zones<br />de résidence doit être aboli. Ce système favorise les résidents<br />urbains au détriment des habitants des zones rurales. Nous devons<br />créer un système qui accorde les mêmes droits constitutionnels à tous<br />les citoyens et leur accorde la même liberté d'habiter où ils veulent.<br /> 9. Liberté d'association Le droit des citoyens à former des<br />organisations doit être garanti. Le système actuel pour la<br />reconnaissance des organisations non-gouvernementales, qui exige<br />qu'elles soient "approuvées", doit être remplacé par un simple système<br />d'enregistrement.<br /> La formation de partis politiques doit être régie par la<br />Constitution et les lois, ce qui signifie qu'il fait mettre fin au<br />privilège spécial accordé à un parti qui a le droit de monopoliser le<br />pouvoir, et nous devons garantir le principe d'une concurrence libre<br />et égale entre tous les partis politiques.<br /> 10. Liberté de réunion La Constitution doit prévoir que les réunions<br />pacifiques, les manifestations, protestations, et la liberté<br />d'expression sont des droits fondamentaux des citoyens. Le parti au<br />pouvoir et le gouvernement ne peuvent pas être autorisés à soumettre<br />ces droits à des obstacles illégaux et inconstitutionnels.<br /> 11. Liberté d'expression Nous devons rendre universels la liberté<br />d'expression, la liberté de la presse, et la liberté universitaire,<br />afin de permettre aux citoyens d'exercer pleinement leur droit d'être<br />informés et d'exercer leur droit à la supervision politique. Ces<br />libertés doivent être garanties par une Loi sur la presse qui abolisse<br />toutes les restrictions politiques imposées à la presse. Le crime<br />d'"incitation à la subversion contre le pouvoir de l'Etat", qui existe<br />actuellement dans la loi chinoise, doit être aboli. Nous devons cesser<br />de considérer les mots comme des crimes.<br /> 12. Liberté religieuse Nous devons garantir la liberté religieuse<br />et de foi, et instaurer la séparation de la religion et de l'Etat. Il<br />ne doit pas y avoir d'ingérence du gouvernement dans les activités<br />religieuses pacifiques. Nous devrions abolir toute loi, décret ou<br />règlement local qui limite ou interdit la liberté religieuse des<br />citoyens. Nous devrions abolir le système actuel qui exige l'accord<br />préalable de l'Etat pour tout groupe religieux ou tout lieu de culte,<br />et le remplacer par un système où l'enregistrement devrait être<br />optionnel, et, pour ceux qui choisissent de s'enregistrer,<br />automatique.<br /> 13. Education civique Nous devrions abolir dans nos écoles les<br />programmes d'éducation politique et les examens qui s'y rattachent, et<br />qui constituent un endoctrinement idéologique des élèves en faveur du<br />soutien à un parti politique. Nous devrions les remplacer par de<br />l'éducation civique, qui fasse la promotion des valeurs universelles<br />et des droits des citoyens, développe la conscience civique, et fasse<br />la promotion de valeurs civiques qui servent la société.<br /> 14. Protection de la propriété privée Nous devrions établir et<br />protéger le droit à la propriété privée, et promouvoir un système<br />économique de marché libre et honnête. Nous devrions abolir les<br />monopoles gouvernementaux sur le commerce et l'industrie, et garantir<br />la liberté de créer de nouvelles entreprises.<br /> Nous devrions créer un Comité des entreprises d'Etat,<br />responsable devant le Parlement, qui supervisera le transfer de la<br />propriété de l'Etat vers le secteur privé d'une manière honnête,<br />concurrentielle, et ordonnée. Nous devrions mettre en oeuvre une<br />réforme agraire qui favorise la propriété privée de la terre, qui<br />garantisse le droit d'acheter et de vendre la terre, et permettre à la<br />véritable valeur de la propriété privée de se réléter dans le marché.<br /> 15. Réforme financière et fiscale Nous devrions créer un système de<br />finances publiques régulé de manière démocratique, et redevable, de<br />manière à protéger les droits des contribuables, et respectueux de<br />procédures établies. Nous avons besoin d'un système dans lequel les<br />revenus d'un certain niveau de gouvernement -central, provincial,<br />dictrict ou local- soient contrôlés à ce niveau.<br /> Nous avons besoin d'une réforme fiscale qui abolira tout impôt<br />injuste, simplifiera le système fiscal, et répartira le fardeau fiscal<br />de manière juste. Les représentants du gouvernement ne devraient pas<br />être en mesure de d'augmenter les taxes ou de créer de nouveaux impôts<br />sans débat public et approbation d'une assemblée démocratique. Nous<br />devons réformer le système de propriété afin de permettre une<br />concurrence plus grande sur le marché.<br /> 16. Sécurité sociale Nous devrions introduire un système adapté et<br />juste de sécurité sociale pour tous les citoyens, et assurer l'accès<br />de tous à l'éducation, à la santé, à la retraite et au travail.<br /> 17. Protection de l'environnement Nous devons protéger notre<br />environnement naturel, et promouvoir un développement qui soit durable<br />et responsable vis-à-vis de nos descendants et du reste de l'humanité.<br />Cela signifie que les responsables gouvernementaux, à tous les<br />niveaux, non seulement s'engagent à faire tout ce qui est possible<br />pour atteindre ces objectifs, mais acceptent la supervision et la<br />participation des organisations non-gouvernementales.<br /> 18. Une république fédérale Une Chine démocratique devrait agir<br />comme une puissance responsable contribuant à la paix et au<br />développement dans la région Asie-Pacifique, traitant avec les autres<br />dans un esprit d'égalité et de honnêteté. /><br /> 还记得我们曾经铺下天罗地网,甚至狠下心放老鼠-无奈,被老鼠拆穿;放粘帖-饵料被吃,但粘不到!<br /><br /> 就在今晚,美霖在客厅忽然问谁的鞋被咬。刚完成大考的我我和正在准备大考的室友就出去看看,这时,我那成绩优良但不像书呆子的法律系室友看了鞋后就说:'老鼠可能还在附近 。 ’接着我顺便整理一下鞋架,老鼠这时跑出来;跑到楼梯角落。楼梯角充满杂物,包括以前住户留下的东西,这的确是老鼠躲藏的好地方。<br /><br /> 此时我们连忙把杂物搬出来,现场一片狼藉。室友的头还敲到楼梯-希望他能保持聪明。没办法啦,轮到我搬啦,我戴上安全帽钻进去搬。最后只剩下一排杂物,室友就拿着扫把棍咬牙切齿的要杀鼠。为了逼老鼠跑出来,我向美霖借了蚊油,喷向楼梯角,无奈还是不出来,没法了,戴上安全帽,再钻一次。果然,驱赶后,老鼠跑出来。室友就这千钧一发的时刻挥棍,老鼠卡在箱子旁,要杀鼠简直是易如反掌;但,他打不下,嘴里说;‘算了吧,放它走吧!’<br /><br /> 这时我连忙打开大门,用棍子把老鼠赶出去。无奈,老鼠一直赶不出,还在庭里乱跑,然后躲在沙发后,一直叫着。这时,全家唯有的男生都出动了,我们排起阵法;像打勾球一样的用纸皮把老鼠挥出去。<br /><br />
